New register of providers engaged in exchange services between virtual currencies and fiat currencies and custodian wallet providers

The consultation of the registers is one of the services of the Banco de España most demanded by citizens, both the registration of entities and that of agents and distributors.

Recently, the Banco de España has incorporated a new registry, that of providers engaged in exchange services between virtual currencies and fiat currencies and custodian wallet providers, protected by an amendment to the legislation on the prevention of money laundering (Law 10/2010Abre en ventana nueva) that requires these providers to also be registered in their own registry.

• As providers of virtual currency exchange services for fiat currency, natural or legal persons offering in Spain the purchase and sale of virtual currencies in exchange for euros or other foreign currency of legal tender in their country of origin must register.
• Natural or legal persons or entities offering private cryptographic key custody services in Spain on behalf of their clients for the holding, storage and transfer of virtual currencies should register as custodians of electronic wallets.

It should be borne in mind that the fact that a person or company is registered in this register does not mean that the Bank of Spain has approved or verified its activity. In addition, the obligation is exclusively for registration, as no supervisory rules have been established by the Banco de España for these providers.

Therefore, registration in this register does not imply that the Banco de España has approved or verified its activity.
