What happens after you file a claim with the Banco de España?

If your claim or complaint contains all the documentation required, you will receive a notification indicating that it has been admitted for consideration. Don’t forget that there are certain

. Your bank will then be requested to submit statements in response to your claim, and these will be sent to you. You will be able to read them and to express your agreement or disagreement with them.Once all the information has been gathered, the Banco de España will issue a report including clear conclusions on the issues raised within the legally stipulated period. The report may be:

In favour of the claimant, if it considers that the institution’s conduct:

Was not in keeping with the principles of good banking practice, or
-
Infringed the transparency and customer protection regulations.

In favour of the institution, if it considers that the institution’s actions did not infringe good banking practices or the transparency and customer protection regulations.
Remember that once the report has been issued, the decision cannot be appealed and the procedure with the Banco de España is considered finalised. As an individual, you are still entitled to defend your interests in court.
