Right to rent in the event of foreclosure of the main residence

This measure may be requested by debtors whose main residence has been foreclosed and whose eviction has been suspended.

An eviction is suspended when, in a foreclosure process, the foreclosed home is the main residence of persons who are in the following cases of extreme vulnerability and economic circumstances:

    1. Large family, in accordance with current legislation.
    2. Single-parent family unit with at least one child.
    3. Family unit including a minor.
    4. Family unit in which one of the members has a recognised degree of disability equal to or greater than 33%, is a situation of dependency or suffers from an illness that results in accredited permanent incapacity for work.
    5. Family unit in which the debtor is unemployed.
    6. Family unit that has, living in the same dwelling, one or more persons who are related to the mortgagor or his/her spouse up to the third degree of consanguinity or affinity and who are disabled, requiring long-term care or suffering from an illness that results in temporary or permanent incapacity for work.
    7. Family unit including a victim of gender violence.
    8. The mortgage borrower is aged over 60.
    1. Que el conjunto de los ingresos de los miembros de la unidad familiar no supere el límite de tres veces el IPREM anual de catorce pagas.
      El límite será de cuatro veces en los supuestos 4 y 5 del apartado anterior y de cinco veces en el caso de que el ejecutado sea persona con parálisis cerebral, con enfermedad mental o con discapacidad intelectual, con un grado de discapacidad reconocido igual o superior al 33 por ciento, o persona con discapacidad física o sensorial, con un grado de discapacidad reconocido igual o superior al 65 por ciento, así como en los casos de enfermedad grave que incapacite acreditadamente, a la persona o a su cuidador, para realizar una actividad laboral. Además, el límite definido para cada caso se incrementará por cada hijo a cargo dentro de la unidad familiar en 0,15 veces el IPREM para familias monoparentales y 0,10 veces el IPREM para el resto de familias.
    2. Que, en los cuatro años anteriores al momento de la solicitud, la unidad familiar haya sufrido una alteración significativa de sus circunstancias económicas, en términos de esfuerzo de acceso a la vivienda.
    3. Que la cuota hipotecaria resulte superior al 50% de los ingresos netos que perciba el conjunto de los miembros de la unidad familiar. 
    4. Que se trate de un crédito o préstamo garantizado con hipoteca que recaiga sobre la única vivienda en propiedad del deudor y concedido para la adquisición de la misma.

The debtor will be able to request the rental of his/her main residence as soon as the eviction is suspended.

In return for this rental, the debtor will pay a maximum annual rent of 3% of the value at the time the auction was approved. This value will be determined according to the appraisal provided by the debtor, certified by an approved appraiser.

The lease is annual, extendable up to 5 years at the will of the lessee. After this period, both parties may agree on an annual extension for another 5 years.
