Purpose of the loan
In order to apply debt restructuring (the first measure of the Code), it does not matter what the purpose of the mortgage loan was. It could have been signed for the purchase of the house, a business or any other need of the debtor.
In the case of debt reduction or dation in payment of the main residence, it is necessary that the purpose of the loan was the purchase of the main residence, even if the loan was not intended to finance solely and exclusively this purchase. For example, the loan could have been signed for the house purchase and for the establishment of a business (or any other purpose).
