I have been included in a register of non-performing loans. How can I find out what details of mine are in it?

When you apply for financing, you may be rejected by the bank because you are included in a register of non-performing loans for non-payment of a debt. These lists are very useful for banks when determining a transaction’s risk: they consult them before granting financing in order to ensure that you are sufficiently solvent to meet the payment.

These registers contain personal details of those who have failed to make a payment. However, before including you in the register, the bank must have requested that you pay the debt.

  • The person responsible for the file must inform you of your inclusion within a maximum period of 30 days.
  • If you know that your details are included in a register of non-performing loans and you wish to obtain information, you should request it from the company responsible for that register, as the Banco de España has no powers over this type of register or over the companies managing them.
  • If you disagree with your inclusion in a register of non-performing loans, you should contact the Spanish Data Protection AgencyAbre en ventana nueva, which is the competent body for complaints relating to data protection regulations.
