Financial intermediation in the credit market

It should be noted that some activities typical of financial institutions, such as offers of intermediation between customers and institutions or the granting of loans, are not reserved for supervised institutions and may be carried out by individuals or legal entities other than financial institutions which, in addition, tend to combine them with other types of activities (advisory or agency services, real estate intermediation, etc.).

The legal regime of real estate credit intermediaries, their representatives and real estate lenders is established in Law 5/2019Abre en ventana nueva regulating real estate credit agreements.

These intermediaries must be registered in a register managed by the Banco de España or the autonomous (regional) communities, depending on the region in which the intermediary operates.

The same criterion for the registration of real estate credit intermediaries applies to their supervision, and the Banco de España is responsible for the supervision of the intermediaries operating in Spain through a branch or under the principle of freedom to provide services.
